Why your social security disability claim may be denied. Hi I’m Youssef Khanachet and I’m an attorney at Farah and Farah. There are several reasons why your social security disability claim may be denied. Typically social security disability claims are denied at the initial and first appeal level because social security does not have all the medical evidence and information to properly adjudicate your claim. Here at Farah and Farah were very successful at obtaining disability benefits at the hearing level because we’re able to go in front of a judge and present all the medical records and present arguments for and on behalf of our clients to obtain disability benefits on their behalf.
Other reasons why a claim is denied is the individual does not meet the technical criteria for social security disability benefits. Technical criteria means having enough work credits and paying enough into social security. Additionally for SSI benefits which are based on need if the individual has too many assets then they may not qualify for disability benefits.
Lastly another reason an individual may be denied for disability benefits is they fail to return forms to social security or have lost contact with social security. If you have any questions regarding why you’re denied for social security disability benefits please feel free to contact Farah and Farah. We’re here to help.
