A case that our Gainesville team was working on just last year was a case where our client who was a single man older hardworking gentleman for sure and he had actually done the right thing. He had come across a previous accident and he happened to have amber lights on his vehicle. So he had turned those amber lights on and he had pulled off to let any oncoming traffic know that there was an incident in front of them. This was at nighttime. It was an incredibly foggy evening. As my client had gotten out of their vehicle and they were attempting to make sure that everybody from that previous accident was okay. Another vehicle where the driver was not paying attention came through at full speed, slammed into his vehicle, throwing debris all over the place, cutting up his legs, knocking him to the ground, causing injuries, not only just physical injuries, but really emotional injuries in that particular scenario. And the big obstacle that we had to overcome was in fact liability.
There was a lot of he said, she said as to what actually took place. Did he have the amber light on or did he not? So through our investigations, we were able to determine that the amber light was in fact on. It was plugged in. The filament was working. And ultimately what we were able to do is not only turn a denial into a policy limit settlement, we were also able to seek damages from both vehicles from the previous accident as he was stopping as a good samaritan. But for that accident, he never would have had to stop and been involved in the second accident.
