The Danger of the Treatment Gap

During the April 2025 deposition, Nemeh prepared the client to explain the gap using legitimate medical science, noting that his previous procedures (such as the epidurals) provided temporary relief that eventually wore off, as expected.

The Split Proposal Strategy That Won $450,000 for Our Client

With the surgical recommendation in hand, Nemeh had the leverage he needed. He filed two strategic settlement proposals totaling $450,000.

“We discuss value as a group at this firm and base it on several factors and expert opinions, including life care planners, orthopedic surgeons, urgent care doctors, chiropractors, and more. We don’t just guess,” said Nemeh. “We knew $175,000 was a strong number, but we also knew the surgery recommendation pushed the value much higher. By splitting the proposals, we gave the defense two shots to do the right thing—or face the risk of a much larger verdict at trial.”

The defense tried to settle for $300,000, but Nemeh stood his ground. He knew the client’s worth and the strength of the medical experts they had retained. Sure enough, the defense buckled and picked up both proposals for the full $450,000.
