Family Sues Condo Association, Management Firm in Jupiter Boy’s 2011 Death
The Palm Beach County pedestrian fatality attorneys at Farah & Farah are following a trial that has just begun in which the parents of a nine-year-old boy who was struck and killed by a van in 2011 are suing a Jupiter condo association and a management firm for negligence and wrongful death.
What makes this trial interesting is that the plaintiffs are not blaming the tragic accident on the 83-year-old driver of the mini-van who struck the boy at the entrance of the Villas on the Green condominium complex in Jupiter. Rather, they are asserting that the condo association and management firm were negligent because the hedges at the entrance were too high and the placement of a stop sign blocked the driver’s visibility.
“She stopped where the Villas on the Green told her to stop,” the driver’s attorney told the jury.
The parents’ attorney claims that the hedges at the entrance were approximately 56 inches high — which is nearly twice the 30-inch limit required by Jupiter codes. He also contended the stop sign was a mere 37 inches off the ground, which is nearly four feet shorter than the required height stipulated by the Florida Department of Transportation.
Attorneys for the condo association and management company are blaming the driver for the death, claiming that the fatal car accident was not caused by visibility problems created by the shrubs or the stop sign. They contend the driver didn’t look to her right to see if there were pedestrians or bicyclists coming toward her on the sidewalk.
The attorney for the plaintiffs’ didn’t tell the jury how much he would be asking for in damages, but The Palm Beach Post speculated it could be in the millions of dollars.
