Pradaxa Compensation
Pradaxa (dabigatran etexilate mesylate) is a blood-thinning medication used to treat patients with particular types of heart conditions or vascular conditions. It works by reducing the ability of the blood to form clots. The drug is meant to reduce the risk of a stroke or pulmonary embolism caused by a clot but is also known to expose the patient to an increased risk of serious injury or death from uncontrolled bleeding.
The U.S. Food and Drug Administration (FDA) is investigating reports of Pradaxa-related injuries to determine whether the drug should be recalled. If you’ve been injured by Pradaxa or one of Pradaxa’s side effects, however, you don’t have time to wait for a recall to be announced – and you don’t have to wait to seek justice. The Jacksonville drug injury attorneys at Farah & Farah may be able to assist you with your case.
Types of Damages
If you were prescribed Pradaxa and injured by the drug, you have the legal right to seek compensation from any party whose negligence may have been responsible for your injuries. If you and your lawyer prove your case in court, you are entitled to monetary compensation, also known as damages.
Damages obtained may be economic and/or non-economic.
Economic Damages
“Economic” damages, also called “actual” damages, compensate you for the direct financial losses you suffered as a result of your Pradaxa-related injury. They include costs like:
- Medical bills for past and current treatment of uncontrolled bleeding, allergic reactions, or other harms caused by Pradaxa use – including extra measures required during surgery to control bleeding or similar complications.
- Medical bills for any treatment you will need to address a long-term condition caused by Pradaxa use. For instance, if uncontrolled bleeding led to kidney failure, this amount includes compensation for dialysis, medications, and doctor’s appointments you will need to continue to treat the kidney failure.
- The value of lost wages and benefits, such as those you lost due to missing work for Pradaxa-related medical care. If your injuries leave you partly or totally unable to work, this amount will also cover what you lose by no longer being able to pursue your job or career.
- Mileage, durable medical equipment, and other costs related to treating your Pradaxa-related injury.
Non-Economic Damages
Non-economic damages are those that can’t be added up by referring to black-and-white dollar amounts listed on receipts, invoices, bills, or pay stubs. They include compensation for things like pain and suffering, mental anguish, inconvenience, or the loss or diminishment of the ability to enjoy the life that remains to you. The combination of economic and non-economic damages is known as “compensatory” damages.
Because every Pradaxa-related injury differs, the amount of non-economic damages you may receive differs as well. These amounts are typically highest in wrongful death cases in which Pradaxa claims a life because the family’s suffering is intense and the ability to enjoy the rest of one’s life is totally eliminated.
