The Ethicon stapler used was one of the models recalled by the company. In 2018, an appeals court reduced her total reward to $19.6 due to a constitutional maximum for punitive damages.
$5.5 Million Settlement for Grieving Husband
Ryan Strange of Springfield, Illinois, received a $5.5 million settlement in 2017 after the 2013 wrongful death of his wife from what should have been a standard surgery to remove a noncancerous mass on her liver. The surgical stapler had cut a blood vessel but didn’t seal it properly, which resulted in her bleeding to death that same day. The settlement costs were split by Medtronic, which had acquired Covidien in 2014, the Memorial Medical Center, and the practice doctors of the Southern Illinois University School of Medicine’s group.
