How Do You Know if You Have a Wrongful Death Case?

Your case may qualify as a wrongful death case if your loved one’s death occurred because of someone else’s wrongdoing. Georgia Annotated Code Section § 51-4-1 defines a wrongful death as one resulting from the following forms of misconduct by others:

  • Crime
  • Criminal negligence
  • Any other form of negligence
  • Defective products

You may have grounds to file a wrongful death lawsuit if you can prove that the death resulted from another’s wrongdoing. You will need strong evidence, such as accident reports, eyewitness statements, expert witness testimony, forensic data, and medical records. Who Can File a Wrongful Death Claim?

Under Georgia Code § 51-4-2, a spouse may file a wrongful death lawsuit. If there is no surviving spouse, a child may file the claim. If they are a minor, a legal guardian may file the claim. If there is no surviving child, a grandchild may file the claim. The proceeds must be divided equally among the survivors, except that the spouse is entitled to no less than a third of the recovery.

If there is no surviving spouse or children, the law allows the surviving parents to file a wrongful death claim. The proceeds may be divided equally between the parents. However, if they were divorced or separated, one parent may petition the court to determine a fair division of the proceeds.

If there are no eligible survivors, a personal representative such as the executor or administrator of the estate may file the claim. Under Georgia Code § 51-4-5, the next of kin is entitled to the amount recovered as determined by intestate laws. The personal representative may recover the portion of the award designated for economic losses they paid, such as funeral and medical expenses.

Title 51 of the Georgia Code specifies that survivors may recover the full value of a deceased loved one’s life. This recovery may include economic, non-economic, and punitive damages. Economic damages cover financial losses related to the death, including funeral and burial expenses, loss of your loved one’s probable lifetime income had they survived, their medical expenses, and loss of estate value.

Non-economic damages provide compensation for emotional losses, such as mental grief and suffering, loss of companionship, loss of comfort, loss of parental guidance, and your loved one’s pain and suffering.

Punitive damages are only available in limited cases when you have clear and convincing evidence of deliberate misconduct or gross negligence. Under Georgia Code § 51-12-5.1, punitive damages are limited to $250,000, except in product liability claims. They are awarded to punish the defendants and deter future misconduct. For this reason, the state treasury receives 75 percent of any punitive damages awarded, minus attorney fees and costs.
