If You’ve Been Hurt at Work in Athens, You Deserve Justice & Results

When you suffer a work injury, workers’ compensation is a no-fault system that is supposed to grant access to medical benefits and wage replacement in exchange for waiving your right to file a personal injury lawsuit against your employer. When your employer or their insurer tries to deny you those benefits, you may feel like you have no options. However, you do.

Our team can help you fight back and secure the benefits you deserve. Our Athens workers’ compensation attorneys have significant experience dealing with unfair and underhanded tactics from companies and insurers. In addition, if someone other than your employer is responsible for your injury, we can determine if you have grounds for a personal injury action against them.

In a recent workplace injury case, our team represented an experienced farmhand who suffered permanent damage to one eye while assisting with a horse euthanasia. The veterinarian gave him unsafe instructions. Our attorneys argued that the veterinarian’s actions fell under a legal exception for negligence, successfully obtaining a $710,000 settlement before the case went to trial.

Our Notable Work Injury Case Results

Farah & Farah has a track record of securing significant wins for work injury victims. Some noteworthy workplace injury case results we’ve obtained include the following:

  • A $1.5 million wrongful death recovery for the children of a woman killed in a workplace accident because of a poorly-maintained machine
  • A $1.3 million workers’ compensation recovery for a worker who developed repetitive stress injuries
We're dedicated to recovering the compensation you deserve.

What Workers’ Compensation Benefits Can I Receive in Athens, GA?

Workers’ compensation can provide a variety of benefits to injured workers in Georgia, including the following:

  • Medical coverage: Your employer’s workers’ comp insurer will pay for any medical bills and health care expenses resulting from your work injury for up to 400 weeks.
  • Wage replacement: You can receive payments for up to two-thirds of your weekly wages, up to $800 per week, while you are unable to work. If you can only perform lower-paying work after recovering, you can also receive a reduced payment.
  • Permanent disability: You can also receive lifetime medical benefits for catastrophic injuries, including losing a limb or an eye.
  • Vocational rehabilitation: You can get help with finding a job or retraining if you’re unable to return to your previous field.
  • Death benefits: If you die from a work injury, your dependents can receive wage replacement payments and up to $7,500 in burial costs.

Our Athens workers’ compensation lawyers can handle your claim for you, working to secure the benefits you deserve while helping you focus on recovering with your family.

Can I Still Sue While Pursuing a Workers’ Compensation Claim?

With few exceptions, workers’ compensation generally prevents you from directly suing your employer for a work injury. However, if a third party contributed to your accident, such as a contractor, building owner, or maintenance company, you might be eligible to file a lawsuit against them for additional damages.

Our Athens workers’ compensation lawyers can help you identify all potentially liable third parties after a work injury and pursue all compensation available to you.

“Whether the injury is your fault or not, if you hurt yourself on the job, if you make a mistake and you fall, or you get hurt by a machine because you weren't paying attention or following the protocols, you still are entitled to your workers’ comp benefits. They're limited, but the law does provide you some protection.”

Types of Athens Workers’ Compensation Cases We Handle

A work injury can happen in almost any setting. However, some industries see a higher rate of work-related injuries. Workers’ Compensation FAQ

How Long Do I Have To File My Workers’ Compensation Claim?

Under Georgia Code § 34-9-82, workers in Georgia generally have one year to file a workers’ compensation claim after being injured. While there are some exceptions, it’s always best to get started on your claim as soon as possible after a work injury.

Firing an employee for filing a workers’ compensation claim may constitute illegal workplace retaliation. However, an employer can still fire or terminate you for other reasons while you’re receiving benefits. Our Athens workers’ compensation lawyers can help you fight back against any unfair or illegal employment decisions.

In Georgia, you can receive weekly wage replacement payments within 21 days of missing work due to your injury. Depending on how long you’ll be disabled, how costly your long-term medical care will be, and whether you’ll be able to return to your job after recovering, you may be offered a settlement by your employer’s workers’ compensation insurer at any point. If an experienced workers’ comp lawyer advises you to accept the settlement, you should receive payment within 20 days of court approval.

Farah & Farah works on a contingency fee arrangement, meaning we charge no upfront fees for our services. Your initial consultation with our Athens workers’ compensation attorneys is free, and you pay nothing unless we win.
