When Does a Loss Become a Wrongful Death Claim in Georgia?

Georgia Code § 51-4-1 defines a wrongful death as a death that stems from criminal acts, negligence, or defective products. In cases involving negligence, you must prove that someone failed to exercise reasonable care, and that this failure, and not something else, caused the death.

For a successful wrongful death claim, you must prove that all four of the following elements were present:

  • The defendant owed your loved one a duty of care.
  • The defendant breached that duty through reckless or careless actions.
  • The breach of duty is the actual and proximate cause of the death.
  • Your family suffered losses because of the death.

For example, drivers owe other road users a duty to follow traffic laws. A driver breaches that duty by speeding or running a red light. If someone dies as a result, they can be held liable for the family’s losses.

Who’s Allowed To File Your Wrongful Death Claim in Albany?

Georgia Code § 51-4-2 gives spouses the primary right to file a wrongful death lawsuit. If there’s no surviving spouse, the children can file suit. If there is no surviving spouse or child, the parents can file suit. In the absence of a surviving spouse, child, or parent, § 51-4-5 allows an estate representative to bring an action on behalf of the next-of-kin.
