How Does Insurance Work for Uber and Lyft Accidents in Georgia?

When you’re injured in an Uber or Lyft accident, you may be entitled to recover compensation from one or more insurance policies, whether you are a driver or passenger in a rideshare or other vehicle.

Georgia is a tort state, which means that in an accident, you file your claim against the at-fault driver’s insurance policy. State law requires rideshare networks to carry $1 million in general liability insurance, but coverage varies depending on your role in the accident, who caused the accident, and the driver’s status.

If You Are an Uber or Lyft Driver in an Accident

If you’re an injured rideshare driver in an accident caused by another driver, you can file a claim against the at-fault driver’s insurance. If you maintain collision and comprehensive coverage on your Uber or Lyft vehicle, Uber and Lyft also provide collision and comprehensive coverage. This applies if you were on your way to pick up a rider or transporting a rider when the accident happened.

If You Are a Passenger in an Uber or Lyft Accident

If you were injured in an Uber or Lyft accident during a ride, you may be able to file a claim against Uber’s insurance policy, another driver’s insurance policy, or both.

If another driver caused the accident, you must file a claim against that driver’s insurance policy. If the rideshare driver caused the accident, you can file a claim against the rideshare company’s insurance policy, which must provide coverage for up to $1 million in damages.

Fault for an accident isn’t always straightforward. While one driver can be 100 percent at fault, it is not uncommon for drivers to share fault for an accident. If this is the case, you may have a claim against both drivers’ policies.

Determining fault for any accident is crucial in ensuring you recover all the damages you deserve. Our Uber and Lyft accident attorneys work with accident reconstructionists to identify all the parties that share blame for your accident.

If an Uber or Lyft Driver Causes the Accident

If you’ve been hit in your own vehicle by a rideshare driver, you may be entitled to recover compensation from the driver’s personal insurance policy or the rideshare company’s insurance, depending on the driver’s status:

  • If the driver was providing a ride or was en route to pick up a rider, you are entitled to file a claim against the rideshare company’s $1 million liability insurance policy.
  • If the driver was logged into the app but had not accepted a ride, you can still file a claim against the rideshare company’s liability insurance, which provides $50,000 for bodily injury, up to $100,000 per accident, and $50,000 for property damage.
  • If the driver was not logged into the app, you must file your claim against the driver’s personal insurance policy.

If You Were Hit by an Uninsured Driver as a Rideshare Driver or Rider

Uninsured motorist insurance policies cover bodily injuries and property damage caused by drivers who fail to carry insurance. Uber and Lyft both carry uninsured motorist coverage in Georgia, but a recent change in the state rideshare laws has reduced this coverage from $1 million to the following:

  • $100,000 for the injuries of any one person in an accident.
  • $300,000 total for the injuries of multiple people in the same accident.
  • $25,000 for property damage.

If the driver that hit you carried insurance, but the driver’s policy limits are insufficient to cover all of your damages, Uber and Lyft also carry underinsured motorist policies, which cover your damages that exceed the at-fault driver’s coverage, up to the limits listed above.

For example, if the driver that hit you only carried the minimum amount of coverage of $25,000 for injuries to one person in an accident, you could file a claim for up to an additional $100,000 in damages.

Who Is Liable for My Rideshare Accident Injuries?

In most rideshare accidents, the rideshare driver or another driver is liable. However, there are times when Uber or Lyft are also liable at the company level. This could entitle you to file a lawsuit against the rideshare company for damages above and beyond what the insurance covers.

For example, if you are injured by a drunk or reckless rideshare driver, you may be able to hold Uber or Lyft accountable for inadequate driver screening. Our experienced Georgia Lyft and Uber attorneys will investigate the driver’s history and look for evidence to prove that Uber or Lyft was negligent in hiring the driver.

Drivers and rideshare companies aren’t the only parties that may be liable for your accident. Other potential defendants include manufacturers of defective car parts, a government agency that maintained unsafe road conditions, a negligent car repair company, and others.

Identifying all of the liable parties is one of the most important jobs a competent rideshare accident attorney in Georgia does. Each time an additional liable party is identified, the pool of available compensation increases. Call our skilled Georgia Lyft and Uber lawyers today at (877) 245-6707 for a free consultation.

Damages Available Following a Rideshare Accident

If you’ve been injured in a rideshare accident, you may be entitled to receive special damages, which is compensation for your medical expenses, lost wages, property damage, and more. If your injury will leave you with long-term or permanent disabilities, you can also pursue damages for your lost earning capacity.

Some losses following a motor vehicle accident are related to your quality of life and cannot be quantified with a price tag. These are known as general damages and may include the following:

  • Pain and suffering.
  • Loss of enjoyment of life.
  • Loss of bodily functions.
  • Scarring and disfigurement.
  • And more.

If you’ve lost a family member in a rideshare accident, you have the right to pursue damages for your loved one’s burial expenses, medical expenses, pain, and suffering. You can also pursue compensation for your loved one’s lost earnings and your family’s emotional losses, such as loss of companionship, comfort, and guidance.

If you have clear and convincing evidence of intentional misconduct or gross negligence, such as drunk driving, against the at-fault driver, you may be able to significantly increase your compensation by pursuing punitive damages. These damages are awarded as a punishment against the defendant and can be substantial.

What To Do After an Uber or Lyft Accident in Georgia

The most important action you can take after an Uber or Lyft accident is to complete your medical treatment. This safeguards your health and provides proof of the cost and necessity of treatment.

The next most important step is to contact a reputable Georgia Uber and Lyft accident attorney. We perform detailed accident investigations, and the sooner you involve our experienced team of rideshare accident lawyers, the more likely that crucial evidence needed to prove your case will still be available.

We will also deal with the rideshare companies and their insurance companies for you. When you are unrepresented, these companies may take advantage of you while you’re injured. They may persuade you to sign away your rights in exchange for a low-ball settlement. They may claim to be trying to help you while encouraging you to unknowingly make statements they can use against you later.

Don’t let these large, rich companies get away with short-changing you. Before you talk to any of their representatives, call our devoted and skilled Georgia Uber and Lyft accident attorneys at (877) 245-6707.

Georgia Requirements To Drive for Uber or Lyft

The state of Georgia requires all rideshare network drivers to undergo a private background check through the company or maintain a for-hire endorsement on their licenses. To qualify for the for-hire endorsement, the following criteria must be met:

  • No felony convictions in the last 10 years.
  • No sex offenses or offenses against minors at any time.
  • Must submit fingerprints for an FBI background check.
  • Must be a citizen of the United States or a legal, documented immigrant.

You must meet similar criteria to pass the private background checks offered by the rideshare companies. Both companies also perform a motor vehicle record check. Drivers with drunk driving convictions in the last seven years, multiple moving violations, or a single serious moving violation in the last three years are not accepted by Lyft. Uber requires a clean driving record.

Neither Uber nor Lyft require fingerprint background checks for drivers, and this could result in hiring errors.

Lyft requires drivers in Georgia to be 25 years old or older, while Uber allows Georgia drivers to be as young as 21. Both platforms perform new driver screenings annually.
