What Makes Trucking Accidents So Intense?

Trucking accident concerns

Posted on April 5, 2023

Over the years, Farah and Farah has grown into one of our area’s top trucking accident law firms. Because these accidents are larger in scope in a number of ways, they are often far more serious and require additional resources to build a case. With the aftermath of these accidents so great, the stakes are even higher to deliver a positive outcome for our clients.

We sat down with one of our top trucking accident attorneys, Rick Staggard, to get his thoughts on what makes commercial trucking accidents such a tough practice area to work in. Rick also shared why a firm like Farah and Farah is an ideal choice for representation specifically in these types of cases.

Why Are Trucking Accidents More Serious than Car Accidents?

An accident between a semi-truck and a car can be downright catastrophic. Right out of the gate, commercial trucks are far larger and heavier than cars, which means they have more momentum and can cause more damage in an accident.

In fact, a fully loaded tractor-trailer can weigh as much as 80,000 pounds, which is about 16 times the weight of a typical passenger car. This means that even at low speeds, a truck can cause significant damage to a car—and injuries to the passengers within.

Truck drivers are also often required to work long hours and may be fatigued, which can lead to errors in judgment. The Federal Motor Carrier Safety Administration (FMCSA) sets regulations for the number of hours that truck drivers can work in a day and week. However, these regulations may not be enforced, and truck drivers may also face pressure by their employers to work longer hours than they are legally allowed to.

Driver fatigue is a serious issue and can lead to a number of problems, including slower reaction times, impaired judgment, and increased risk of accidents. According to the FMCSA, “driver drowsiness may impair a driver’s response time to potential hazards, increasing the chances of being in a crash.”

The consequences of truck accidents can be devastating. In 2019, there were over 4,000 people killed in truck accidents in the U.S. These accidents can also result in serious injuries, such as spinal cord injuries, brain injuries, and amputations. The financial costs of truck accidents can also be high, including significant vehicle damages, medical expenses, lost wages, and pain and suffering. “This heightens the importance of the job we do every step of the way,” Rick describes.

What Makes Trucking Accidents More Difficult to Pursue?

Even with trucking accidents being more serious, not every accident law firm is equipped to handle these types of cases. There are several factors that can make these cases more difficult to pursue including the size and complexity of trucking companies, having multiple jurisdictions involved, federal trucking regulations, and the sheer amount of evidence to process in an accident scene.

Because the size and scope of the accident is generally larger, a larger law firm is typically required to keep up with the demands of the case. At Farah and Farah, we favor collaboration over competition which means lawyers like Rick can reach out across our entire firm to bounce ideas off of other top-tier legal talent.

Supporting our attorneys, you’ll also find hundreds of other legal professionals like paralegals, case managers, medical records personnel, and investigators all working together to secure the best outcome possible.
