Compensation Possible in a Xarelto Lawsuit
Drug manufacturers Bayer and Johnson & Johnson’s Janssen Pharmaceuticals, Inc. have been aggressively marketing anti-coagulant Xarelto since it was first released onto the market. This drug is being promoted as different from other blood thinners because it requires no regular blood monitoring, no dietary restrictions, and avoids frequent dosage adjustments. Thirteen million prescriptions have been written for Xarelto, as stated on the drug’s website. However, the company is not promoting the severe and life-threatening health risks with this drug.
If you have been seriously harmed or lost a loved one because of Xarelto, you do not have to suffer in silence. Our Xarelto attorneys at Farah & Farah believe that big drug companies should be held accountable for the harm caused by their dangerous drugs. You may be entitled to file a claim for compensation for the losses you have suffered. Our legal team is currently investigating Xarelto cases nationwide.
Serious Side Effects and Health Risks Associated with Xarelto
Since it was approved by the U.S. Food and Drug Administration (FDA) in July 2011, a growing number of severe side effects have been associated with Xarelto. In its QuarterWatch report on adverse drug events, the Institute for Safe Medication Practices (ISMP) states that their researchers identified 356 reports of serious, disabling, or fatal injuries for which Xarelto was the primary suspected cause in the first quarter of 2012 alone.
These adverse events included 121 cases of hemorrhage and 158 cases of blood clot-related injuries, mostly pulmonary embolism (blood clots in the lungs) – the very condition Xarelto is designed to prevent. These blood clot related injuries occurred in a younger patient group with a median age of 66.
ISMP reports that when the institute discussed its findings with the manufacturer, Johnson & Johnson subsidiary Janssen Pharmaceuticals, Inc., company representatives stated that the company had reviewed the same data and saw no indication that a safety issue needed to be addressed. They attributed the growing number of adverse event reports to the company’s success in marketing the drug and capturing 22.5% of the anti-coagulant after hip and knee replacement surgery market by first quarter 2012.
Hundreds of lawsuits have been filed against Xarelto manufacturers by patients who have suffered serious injuries from this drug. Severe and life-threatening Xarelto side effects include:
- Abnormal liver function
- Gastrointestinal bleeding
- Pulmonary embolism
- Deep vein thrombosis
- Spinal epidural hematoma
- Wound leakage and complications
- Stevens-Johnson Syndrome (a life-threatening disorder of the skin and mucous membranes)
How Much Is Your Xarelto Claim Worth?
After serious injuries caused by Xarelto, you may be entitled to recover compensation for your damages. In a successful claim for compensation, you will need to show that Xarelto caused your injuries and establish the full extent of your losses. Our product liability lawyers will tenaciously pursue the maximum compensation, based upon the facts in your specific case.
The amount of your damages will depend on the extent of your losses. In dangerous drug injury claims, compensation may include economic damages (such as medical expenses and lost wages) and non-economic damages (such as pain and suffering, emotional distress, and loss of companionship).
Factors to consider when assessing damages in a Xarelto claim may include:
- What injury did you or your loved one suffer from taking Xarelto?
- How long did the injury last?
- What short and long-term effects did the injury have on you or your loved one?
- What type of care for the injured person will be needed in the future?
- What medical expenses have already been incurred because of the injury?
- What medical expenses can be expected in the future?
- How much has been lost in wages or earnings because of the injury?
- In the case of disability, how much will be lost in future wages or earnings?
- In the case of wrongful death, what financial support will no longer be available to dependents?
- After the loss of a loved one, to what extent will loss of companionship exist for survivors?
